Terms and conditions of using ELaHoL
Use of the ELaHoL website to view and book holiday rentals is free for prospective holidaymakers. Under no circumstances can the site be used for any purpose whatsoever other than viewing properties for rent, or for contacting landlords for the purpose of enquiry and/or booking a property. The content of the site is protected by copyright and may not be used by third parties for commercial or other purposes not authorized by ELaHoL in writing.
The following terms and conditions are applicable to all visitors to the ELaHoL site. Unless authorised in writing by ELaHoL beforehand, or legally permissible, the following terms are binding :
The site is solely to be used to contact owners of advertised properties for the purpose of obtaining further information about the property; or other pertinent enquiries, including booking details.
The pages are protected by copyright, but may be downloaded for personal use only. Commercial use is strictly prohibited and the information contained may not be sold to third parties. The content may not be modified in any way whatsoever, and any downloaded /copied pages must show the copyright notice as displayed, without any modification whatsoever.
The contents may not be copied, reproduced, uploaded, posted, displayed, republished, distributed or transmitted in any form whatsoever.
The contents may not be reproduced on any Website not authorised by the company, using any device including but not limited to the use of any frame or border environment round the Website, or any other framing technique to enclose any portion or aspect of the Website; or replicate or mirror any portion of the Website.
The contents may not be translated into any other language, including computer languages, or undergo any modification whatsoever or be used to create derivative works from the contents or Website or any part thereof.
No reverse engineering is permitted whatsoever in any part of the Website.
The Website or any part thereof may not be licensed, offered for sale or transferred to a third party.
The contents may not be copied, or the database reproduced and kept by third parties; nor is the use of any automatic devices, including but not limited to spiders and robots, or any manual process, permitted.
Use of the Website, other than for contacting advertisers with legitimate enquiries about rental properties, is strictly prohibited.
Only Bona Fide bookings will be accepted. Use of the Website for fraudulent or speculative bookings is strictly prohibited.
Use of the Website to post or transmit any material that would constitute a criminal or civil offence, violate the law, or give rise to unlawful acts including but not limited to; threatening, libellous, defamatory, obscene, inflammatory, pornographic or other behaviour likely to give rise to distress is strictly prohibited.
Use of the Website that, in ELaHoL’s reasonable opinion, adversely affects the integrity of the site, including but not limited to the performance and function of the site or computer systems used by the company, or infringes the copyrights of the company and/or its advertisers is strictly prohibited.
Deliberate use of any software, routine or device to upload or transmit viruses, including but not limited to, Trojan horses, time bombs, worms or any other computer programs and/or routines that may damage or disable the Website; or any attempt to interfere or intercept the normal functioning of the Website or the company’s computer system, including but not limited to imposing an unreasonable load on the system, and adversely affecting the rights of third parties legitimately using the Website is strictly prohibited.
The origin of all information transmitted through the Website must be clearly shown. Any attempt to disguise the origin of the transmission is strictly prohibited.
The company and its affiliates accept no liability for any damages, without limitation, from any indirect, consequential, special, incidental or punitive damages arising out of, or based on, or as a result of use of this service; even if the company and its affiliates are advised of the possibility of such damages, whether or not these damages arose as a result of:
- Breach of Contract
- Breach of Warranty
- Strict Liability
- Tort
- Negligence
Or any other cause, to the extent that such limitations are not prohibited by relevant consumer laws. In addition, the directors, affiliates, partners, service providers, vendors, contractors and each of their respective agents, directors, officers, employees and all other related persons or entities are released and discharged from responsibility for any claims arising out of any and all manner of rights, claims, complaints, demands, causes of action, proceedings, liabilities, obligations, legal fees, costs and other disbursements of any nature whatsoever, whether known or unknown, which now or hereafter arise from, or relate to, or connected with your use of the service.
ElaHoL reserves the right to add your e-mail address to their database and to pass it on to its affiliates, when you send an enquiry to an advertiser on the Website. You will receive at least one promotional e-mail from us and/or our affiliates. Should you prefer not to receive any e-mails, you may opt out at any time.
Using the services provided by the company and its affiliates constitutes agreement with all the terms and conditions above.
Terms and condition for advertising on ELaHoL
ELaHoL reserves the right to edit all copy, layout and design of advertisements to conform to the protocol of the website. The company also reserves the right to amend the designs, layouts and photographs where necessary. Every effort will be made to reproduce the advertisement accurately, but the company accepts no liability whatsoever for any loss or damage resulting from errors or omissions.
The company will make every effort to ensure the safety of all materials submitted, but all such materials are submitted at the owner’s risk and the company cannot be held responsible for any loss or damage howsoever caused. The company will return any material to the advertiser if requested.
Advertisers are responsible for the accuracy of their advertisements and must ensure that the availability of the property is updated in a timely manner.
The company cannot guarantee that the site will be uninterrupted or error free and accepts no responsibility for any loss or damages, direct or indirect, or lost profits, resulting from any malfunction or interruption of the site.
ELaHoL cannot be held responsible for any loss or damage resulting from the design or placement of the property, or from changes made to photographs or any other images, on the website. Nor can it accept any legal responsibility for the accuracy of advertisements. Neither can it accept any responsibility for any claims for damages, costs or other expenses, legal or otherwise, resulting from alleged breaches of contract arising from the content of the advertisement. In the event of such claims arising, the advertiser will indemnify ELaHoL from any and all financial and/or legal claims and actions.
WARNING:
ElaHoL cannot be held responsible for any breaches of copyright resulting from advertisements. Advertisers must ensure that all material, in whatever form submitted, is free from copyright, or have permission to use the images and/or text submitted. In the event of any actions arising from a breach of copyright, the advertiser will indemnify ELaHoL from any and all costs.
ELaHoL reserves the right to reproduce all or part of any photographic material submitted by the advertiser, and claims copyright to all electronic images of photographs submitted.
ELaHoL reserves the right to refuse hypertext links or addresses of other websites from advertisers pages, and reserves the right to remove such links without notice at any time.
Testimonials must be genuine and the company reserves the right to demand the e-mail addresses of clients whose comments have been quoted in advertisements.
Advertisements are accepted for specific properties only and no substitutions are permitted. Only one property per advertisement is allowed. Multiple properties or examples of properties in a particular area will not be accepted in a single advertisement. Advertisers who wish to advertise several properties on the same site must take out multiple advertising slots. ELaHoL reserves the right to amend or remove advertisements which breach these guidelines.
Termination of Contract
Advertisers may choose to remove their advertisement before the end of their contract, but in that event no refunds will be given.
ELaHoL reserves the right to refuse any advertisement and accepts no liability for any loss or expense incurred by the advertiser.
Advertisers who misuse the database or other systems, or attempt to publish unsuitable material, will have their properties removed from the website and will forfeit their fees.
ELaHoL reserves the right to remove a property from the website, if it receives documented and justifiable complaints from consumers, without notice and will not make any refunds to the advertiser. Advertisers who breach ELaHoL’s guidelines will have their property removed from the website and will forfeit their fees.
Authorization to Export Data
ELaHoL and its affiliates reserve the right to keep copies of advertising content outwith Greece and the EU. In this case, ELaHoL and its affiliates will not share the information with any third parties and will only use the information for necessary internal operations within the company and its affiliates.
Payment
All major credit cards are accepted and payments can be made online through a secure site run by EUROBANK SA. Euro cheques are also accepted, but are subject to a handling fee of €10. VAT is chargeable at local rates, unless a certificate of exemption is provided.
